Welcome to Optim websites together with any materials and services available therein, and successor site(s) thereto (individually referred to as the “Site” or collectively as the “Sites”), which are operated by Optim Recruiting LLC and its subsidiaries (“Optim” or “we” or “us”).
This Privacy Notice (“Notice”) describes how Optim may use and disclose information that we may collect about all users and viewers through the Sites.
The Terms of Use (“Terms”) state the terms and conditions governing your use of and access to the Sites and constitute a legally binding contract between you and Optim. The Terms incorporate any additional terms and conditions posted by Optim through the Sites or otherwise made available to you by Optim.
In the event of a conflict between this Notice and any other applicable terms or agreement fully executed by you and Optim (“Other Terms”), the Other Terms shall control.
Collection of Personal Information
When you use or register with the Sites, we may collect certain information that identifies you as an individual or relates to an identifiable individual (“Personal Information”).
The categories of Personal Information we may collect include:
With respect to visitors of the Site, we collect the following categories of information either automatically from your browser or directly from you when you visit our Site.
Internet activity, such as your browsing activity on the Site, cookies, installed plug-ins, and javascript objects.
Device Data, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, date, and Internet browser type and version.
IP address, which is a number that is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Sites, along with the time of the visit and the pages visited.
Geolocation data, which is data derived from your IP address that indicates your approximate location and enables us to better serve you based on the area you are currently in
Identifiers, such as your first name, last name, and email address, if you wish to download certain reports like our salary guides
Professional information, if you wish to download certain reports like our salary guides, in which case you will need to provide your job title
With respect to job applicants and our employees who use the Sites (“Candidates”), we collect the following categories of information:
Identifiers, such as your full name and any login ID and password created by you
Contact information, such as your email address, mailing address, home address, and phone number
Professional or career-related information and education information, such as your job search criteria and preferences, your availability to work, your work experience, educational history, your skills, reference information, background check information, pay / compensation expectations, ability to work in the United States, languages spoken, and other information contained in your resume
Protected Classifications under State or Federal Law including gender, age, and military/veteran status
Additional information may be collected as part of employee onboarding.
With respect to individuals who are business clients or prospective clients of Optim who use the Sites (“Customers” or “Prospective Customers”) and any corporation, partnership or other entity on behalf of which a Customer or Prospective Customer is using the Sites, we collect the following categories of Personal Information :
Identifiers, such as your name, business phone number, and work email
Professional or employment-related information, such as your company name, department, and job title
Financial information, such as bank account and payment information if we render services to you, depending on how you elect to pay for services rendered
With respect to vendors, we collect the following categories of Personal Information from you or Optim’s business contacts who may wish to recommend you:
Identifiers, such as your name, business phone number, and work email
Professional or employment-related information, such as your company name, department, and job title
Financial information, such as bank account information, so we can pay you for providing products or services to Optim
With respect to marketing recipients, we collect the following categories of Personal Information from you:
Identifiers, such as your first and last name
Contact information, such as phone number and email address
Professional or employment-related information, such as your company name, department, and job title

Service providers such as job boards or background check providers
Tracking Technologies (defined below)
Third parties from whom we have purchased business contact information

Business and Commercial Purposes for Use of Personal Information
We use your personal information for a variety of business and commercial purposes, including to:
Provide our Sites and Services to You. We use your personal information to facilitate, manage, and administer the Sites, create and manage your account, process feedback, provide you with information about job opportunities and career related information, schedule meetings, send you notifications related to your account, and perform other related functions.
Provide our Services to Customers. We use your personal information to serve our Customers and Prospective Customers, such as through providing recruitment and staffing services.
Respond to Your Inquiries and Requests. We use your personal information to communicate with you, such as to respond to your requests, inquiries, issues, feedback, and provide our customer service functions.
Market and Advertise. We use your personal information for marketing and advertising purposes, including sending marketing, advertising, and promotional communications by automated email, text message (message and data rates may apply), or postal mail. We also use your personal information to show you advertisements for our Services. For more information, please see the Cookies, Pixels, and Online Tracking Technologies section, as well as the Retargeting section of this Notice.
Conduct Analytics and Personalization. We use your personal information to conduct research and analytics, including to improve the Sites and our Services based on how you interact with our Sites, advertisements, Services, and communications. We also use your personal information to personalize and improve your experience with the Sites and better understand your needs.
Quality Control and Training. We use your personal information from customer service interactions (e.g., phone calls and online chats) to help train our employees and ensure that the services that we provide meet our quality standards.
Security and Fraud Prevention. We use your personal information to help detect, investigate, prevent, or take action regarding potential malicious, deceptive, fraudulent, abusive, or illegal activity, such as security incidents or harm to other users of our Services.
Legal Obligations. We use your personal information to comply with federal, state, and local legal and regulatory obligations, establish and exercise our rights, and to defend against legal claims.
Business Functions. We use your personal information to support our core business functions, including maintaining records related to business management, loss prevention, collecting amounts owed, and facilitating audits.
Sales or Sharing of Personal Information
Certain uses of our Tracking Technologies (defined below) may be considered a “sale” or a “share” of your personal information to third parties under applicable law. The categories of personal information we may sell or share in these circumstances include your IP address, persistent online identifiers, ad identifiers, similar information about your devices and browsers, and information about your engagement with our Sites, Services, and Communications. We have no actual knowledge that we sell the personal information of California residents who are under 16 years of age. You have the right to opt-out of the sharing of your personal information. Please note that these opt out tools are limited to the device and web browser used to opt out because they work off of your device ID or browser ID. If you utilize another device or browser, you will need to opt out on each device and browser. If you block or clear cookies from your browser, that may remove the opt out setting, requiring you to opt out again.
Disclosure of Personal Information
For business and commercial purposes, Optim may disclose to third parties the following categories of Personal Information:
Identifiers, such as your name and email address
Protected classifications, under State or Federal law such as gender
Internet or other electronic activity information, such as network activity information or information obtained from your device like browsing history on the Sites, IP address, search history on the Sites, your interaction with an advertisement, installed plug-ins, and javascript objects on your device.
Financial and payment information, like your direct deposit or bank account information so that workers can be paid and Customers can pay us.
Geolocation data
Professional, career, or employment-related information
Education information
Optim may disclose such Personal Information to the following categories of third parties:
Service Providers. We may disclose Personal Information with our third-party service providers who perform business functions and services on our behalf, such as internet service providers, advertising networks, data analytics providers, operating systems and platforms, social media networks, payment processors, the provider of Optim’s customer relationship management solution, and other service providers who provide us a service (e.g., customer service, auditing, marketing, information technology, cybersecurity).
Customers and Prospective Customers. Businesses for whom Optim may perform recruiting services may request professional and employment-related information for purposes of evaluating a Candidate’s credentials, skills and experience. Customers may also need to approve and process timesheet information for Candidates.
Candidates. We may share Personal Information of our Customers or Prospective Customers to Candidates such as when a Candidate must know information about whom to contact when going on an interview or to a job with a Customer.
Legal Process and Protection. We may disclose Personal Information to regulatory authorities, government authorities or courts to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to: (a) comply with the law requiring such disclosure; (b) protect the rights or property of Optim or its affiliated companies; (c) prevent a crime or protect national security; (d) protect the personal safety of the users or the public; (e) in connection with claims, disputes, or litigation; or (f) to protect our Sites.
Business Transfers. We also may disclose or transfer information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
Cookies, Pixels, and Online Tracking Technology
We and our third-party partners use cookies, pixel tags, Software Development Kits, and other similar technologies (collectively, “Tracking Technologies”) to gather information about you and your use our Sites. For information about your rights and choices, as well as how to control Tracking Technologies, please see the “Tracking Technology Choices” below. With respect to how long Tracking Technologies stay on your computer or mobile device, some are session-based and expire once you close your browser; others are persistent, meaning they stay on your device until you delete them or they expire.
Tracking Technologies Used
Cookies. Cookies are pieces of information stored on the computer or mobile device that you are using which allow us to collect information about how you use the Sites. This includes, but is not limited to, your browser type, the amount of time spent on the Sites, pages visited, registrations, submissions, demographics, information requests, language preferences, and other traffic data.
Pixels. Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of Site users and email recipients, market our services to you, measure the success of our marketing campaigns and compile statistics about Site usage and response rates.
Software Development Kits. Software Development Kits (“SDKs”) are sets of tools and code provided by third parties that are embedded in our mobile applications to enable specific functionalities and improve user experience. Some SDKs may collect data directly from your device, such as your IP address, device type, or usage patterns, to support these functions.
Why Do We Use Tracking Technologies?
Functionality, Performance, and Support. We use tracking technologies to assist with basic site functions, recognize your device, facilitate navigation, display information more effectively, personalize your experience, manage your account, and save your preferences.
Security and Performance. Some of the tracking technologies we use are to maintain the security of our Sites, prevent crashes, fix bugs, and verify your identity. To assist with identity verification and to protect the Sites and your submissions via the Sites, we use the reCAPTCHA service provided by Google, which uses the following to evaluate your use of the Site: IP address, your device type and information about your device, cookies placed on your device (such as from Google), language and date information, installed plug-ins, and javascript objects. Your use of reCAPTCHA on the Site is subject to the Google Terms and Privacy Policy.
Session Replay. Some of the technologies implemented are used in a manner to recreate your session and understand how you navigated our website, what content or Services you looked at and other related information that helps us assess how our Sites are being used. We may obtain this information through the use of cookies and pixels, and may share this with third parties to obtain related insights.
Advertising and Marketing Measurements. Pixel tags may be used to market our services to you, measure the success of our marketing campaigns and compile statistics about Site usage and response rates. Furthermore, we may incorporate pixels from separate entities that allow us to bring you advertising both on and off the Sites.
Behavioral Analytics. We also use pixels in combination with cookies to track activity by a particular browser on a particular device. These pixels are provided by a third-party and certain information may be shared back with such provider. In addition, we may use technologies included in applications (that are not browser-based like cookies and cannot be controlled by browser settings) such as SDKs to track our communications, bring you advertising, and provide you with additional functionality, such as the ability to connect your account on our Sites with other third-party services.
Tracking Technology Choices
The following disclosures relate to your rights and choices in connection with cookies and other online tracking technologies:
Do Not Track. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. The Sites are configured to automatically recognize, and respect Do Not Track and Global Privacy Control signals.
Cookies and Other Technologies.
Browser: Most browsers accept cookies by default. You can instruct your browser, by changing its settings, to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations..
Cookies Tool: Optim also offers a cookie tool in the bottom left hand corner of the Site that looks like a cookie.
By clicking on the cookie icon, you will be taken to our cookie tool which will allow you to manage and opt-out of cookies that are not considered “Strictly Necessary” cookies.
Third Party Services
This Notice does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which the Sites link, or any device through which you access the Sites.
Security
We use reasonable organizational, technical and administrative measures designed to protect Personal Information within our organization. However, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us.
If you no longer want to receive marketing-related emails from us going forward, you may opt-out by using the mechanism contained in each such email.
SMS
If you no longer wish to receive marketing-related texts from us on a going-forward basis, you may opt-out by texting “STOP” to us at any time. You may text “HELP” to us relating to text messages we send.
Data Retention
We keep your Personal Information for as long as needed or permitted based on the purpose(s) for which it was obtained. The criteria used to determine our retention periods include: (i) the nature and timing of our relationship with you; (ii) the legal and contractual obligations to which we are subject; or (iii) our relevant legal position based on applicable statutes of limitations, litigation, or regulatory investigations.
We may delete Personal Information for inactive accounts from our database, subject to any applicable legal or regulatory obligations. Furthermore, we may delete Personal Information from our database at any time and without providing any reason.
Use of Site By Children
We do not knowingly collect, sell, or share Personal Information from children under 16 years old, as those terms are defined under the California Consumer Privacy Act. If we become aware that we have received or collected Personal Information about a child under 16 years old, we will delete that Personal Information as soon as possible.
Exercising Your Privacy Rights
Depending on where you reside, you may have certain legal rights in relation to your personal information such as the right to know and access, right to delete, right to correct, right to opt-out of sale or sharing of your personal information, and the right to non-discrimination. If you would like to exercise any such rights, you may do so in the following ways:

Once you have submitted a request to exercise your privacy rights, we will need to verify your identity in order to maintain the security and accuracy of your personal information. You may be asked to provide identifying information including your full name, email address, and phone number, which will be compared against the personal information we have on file. You will also be asked to verify your email address after submitting your request. If the information you provide does not match our records or you fail to verify your email address, your request may be rejected.
Certain states also provide their residents the right to appeal the outcome of a privacy request. If you are a resident of one of these states and would like to appeal an outcome, you may appeal that decision by submitting a new request through one of the above methods and selecting “Appeal” as the Request Type when prompted.
California Residents
If you are a California resident, you have the right, subject to certain exceptions detailed in the California Consumer Privacy Act, as amended, and other applicable laws and regulations, to:
request access to your Personal Information, including information about specific pieces of Personal Information we have collected about you. If you wish to know the categories of Personal Information we have collected, the categories of sources from which we have collected your Personal Information, the business or commercial purpose for collecting or sharing your Personal Information, and the categories of third parties to whom we disclose Personal Information, please see the foregoing sections of this Privacy Notice, including but not limited to Sections 1, 2, and 4.
request deletion of your Personal Information; however, to the extent permitted by applicable law, we may be required to retain some of your Personal Information, and certain Personal Information is strictly necessary for us to fulfill the purposes described in this Notice;
if we maintain any inaccurate information about you, request correction of that inaccurate Personal Information;
for sensitive Personal Information that we collect, request that we limit our use of your sensitive Personal Information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests such goods or services and as otherwise authorized under applicable laws;
request information about the Personal Information about you that we have disclosed for a business purpose and the categories of persons to whom it was disclosed for a business purpose;
request information about the Personal Information about you that we have "sold" or "shared" (as such terms is defined under CCPA) and the categories of third parties to whom the Personal Information was sold or shared.
